The Pregnant Workers Fairness Act: Guidance for Owners and Leaders in ABA Organizations

In June 2023, the Pregnant Workers Fairness Act (PWFA) was passed and this law mandates employers to provide reasonable accommodations to pregnant workers unless the accommodation causes the employer an “undue hardship.” It is important that Behavior Analysts who employ, manage, and supervise others are aware of the PWFA and are able to recognize potential violations of PWFA. Violations of PWFA may lead to EEOC Claims, fines, and penalties. Many women fear discrimination from employers when pregnant and leave the workforce during their pregnancy. 72% of all women will become pregnant while working at some point in their lives (EEOC, 2023). 86.09% of the field of ABA is comprised of women (BACB, 2024), and this course will discuss the legal and ethical necessity of Behavior Analysts in leadership positions to comply with PWFA in their organizations.

Individuals who take this course will be able to:

  • Compare and Contrast clinical supervision and managerial supervision responsibilities of the BCBA or BCaBA
  • Define ethical code(s) that BCBAs and BCaBAs should follow as managerial supervisors
  • State law(s) to know to effectively manage technicians in supervisorial roles
  • Explain components of the Pregnant Workers Fairness Act
  • Identify other federal laws that intersect with the Pregnant Workers Fairness Act
  • Indicate risks to violating federal laws related to pregnant workers
  • Discuss reasonable accommodations for pregnant workers
  • Develop strategies to cultivate an inclusive workplace
